TERMS AND CONDITIONS
Check-In & Check-Out Times:
- Check-In: 4:00 PM
- Check-Out: 10:00 AM
Minimum Age Requirement:
- The minimum age for reserving a unit is 27. Guests under the age of 27 may only occupy a property when accompanied by someone who meets the age requirement.
Maximum Occupancy:
- Two-Bedroom Unit: Maximum occupancy is 4 persons with the exception for unit 308 occupancy of 6.
- Three-Bedroom Unit: Maximum occupancy is 6 persons, including children and infants.
- Four-Bedroom Unit: Maximum occupancy is 8 persons, including children and infants.
- Exceeding the maximum occupancy may result in immediate eviction and forfeiture of payments, at the sole discretion of TEN35 Seaside.
Payment:
- We accept Visa, Mastercard, American Express, and Discover cards. A valid credit card must be provided to confirm the reservation.
- A 20% down payment is required at the time of booking, with the remaining balance due 60 days prior to arrival.
- Reservations made less than 60 days prior to arrival 100% payment will be due at the time of booking.
Cancellation Policy:
- Less than 14-day stay: Cancellation must be made at least 30 days before arrival to receive a full refund (minus a $150 cancellation fee).
- 14-day or longer stay: Cancellation must be made at least 60 days before arrival to receive a full refund (minus a $150 cancellation fee).
- Refund Process: If cancellation notice is provided within the appropriate time frame, refunds will be processed to the original payment method, minus the cancellation fee. If a refund to the original payment method is not possible, a check may be issued, subject to a 3% processing fee.
- Late Cancellations (less than 30&60 days): We will attempt to re-rent the property. If successful, we will refund the amount paid, minus the $150 processing fee and any re-rental price deficiency.
- Reservation Change Policy for Stays of 14 Days or More
- If you have a reservation for 14 days or more and want to shorten your stay by more than 4 days, you will need to cancel your entire reservation and rebook for the new dates. The new reservation will be at the current rates, which may be different from your original rate.
- No changes are allowed during your stay. In case of emergencies (e.g., hurricanes), we recommend purchasing trip cancellation insurance.
Identification:
- A valid government-issued ID or passport is required at check-in.
Hours of Operation:
- Our office is open daily from 8:00 AM to 5:00 PM. For after-hours assistance, please call 941-925-1035.
Occupancy and Unit Use:
- Only those listed on the reservation may occupy the unit. The reserving party is responsible for the condition of the unit and ensuring compliance with all terms.
- All guests must comply with local, state, and federal laws. Upon checkout, the unit must be left in good condition.
Security Deposit:
- In lieu of a security deposit, a credit card authorization of $1,500 will be required at check-in. The authorization will be released within 7 days after departure, provided no damages or missing items are found. Additional charges may apply for damages or unpaid balances.
Taxes & Fees:
- Sales Tax: All rentals are subject to a 13% sales tax.
- Resort Amenity Fee: $49 per day. This fee covers access to the swimming pool, spa, fitness center, One parking spot, poolside cabanas, beach chairs, umbrellas, bicycles, kayaks, paddleboards, and complimentary Wi-Fi.
Acts of God:
- We are not responsible for refunds due to inclement weather or Acts of God (e.g., hurricanes, storms). In case of evacuation orders, guests must comply immediately for their safety. Refunds are not issued for early departure due to weather conditions.
Rate Changes:
- Rates may change without notice, but confirmed rates will be honored. Additional nights will be charged at current market rates, subject to availability.
Confirmation of Reservation:
- A confirmation email will be sent upon booking, including a link to these Terms and Conditions. Payment confirms acceptance of these terms.
Smoking Policy:
- All units are non-smoking. A $1,000 fee will be charged for smoking in the unit. Please do not apply sunscreen inside the unit, as it may result in a $500 fee.
Noise Ordinances:
- All guests must comply with local noise ordinances. Noise violations, including loud music or disturbances after 10:00 PM, may result in immediate eviction without refund.
Pool and Hot Tub Use:
- Hours of operation: Dawn to dusk. The pool and hot tub are for use at your own risk. Children must be supervised at all times. No diving, toys, or glass are allowed in these areas.
- Children that are not potty trained are required to wear swim diapers. Regular diapers are not permitted in the pool.
Guest Policy:
- The reserving party is responsible for the behavior of all occupants and guests. Unauthorized guests are not permitted to occupy the unit overnight.
- Day Guest: Day visitors are welcome. Visitors are limited to their total room occupancy. If a unit allows for 6 people and you have less than 6 people registered to your unit; then you are allowed the number of visitors to make up the difference. For example, if you are in a three-bedroom that allows 6 people, and you have 4 people registered; then you are allowed up to 2 visitors. Any overnight guests must be registered with the office and are subject to occupancy limits.
Accidents, Injury, or Loss:
- We are not responsible for accidents, injuries, or loss of personal property. The reserving party agrees to indemnify and hold harmless TEN35 Seaside Rentals and TEN35 Seaside Condominium Association for any claims arising from their occupancy.
Air Conditioning:
- Keep the air conditioning set to “AUTO” and “COOL” mode. Do not set the thermostat below 72°F, and avoid operating the A/C with windows or doors open. In order for the A/C and Heating to work properly all thermostats must be on the same setting.
Toilets:
- Only toilet paper should be flushed. Paper towels, wipes, and other items may cause plumbing issues, and the guest will be responsible for any repair costs.
Parking:
- Each unit includes one covered parking space. A parking permit will be provided upon check-in. Additional vehicles may be accommodated for $25 per day, subject to availability. Over-sized vehicles, boats, or trailers cannot be accommodated.
Pet Policy:
- Pets are not permitted on the property, except for service animals. Violations will result in eviction, forfeiture of payments, and a $1,000 fee.
- Service animals are animals that are trained to perform a task. Emotional support animals are not considered service animals.
Furniture and Accessories:
Furniture and accessories should not be removed from the unit. Damages or losses will result in charges for replacement. Beach towels are provided, but bath towels must remain in the unit.
Each unit is furnished by the individual owners, and as such, some units may vary in furniture and decor.
LEGAL NOTICES:
Failure to comply with these Terms and Conditions or applicable Florida laws may, at our sole discretion, result in immediate termination of occupancy without any refund. This agreement is governed by the laws of the State of Florida. We reserve the right to enter the unit at any time.
While the information provided on our website is believed to be accurate, it is understood that such information is for guidance only and does not form a part of this agreement. In any legal action related to the interpretation or enforcement of this agreement, or arising out of your reservation, stay, or use of the unit and its amenities, the prevailing party shall be entitled to recover attorney’s fees and related costs, including fees incurred in pre-suit proceedings, trial, and appellate processes.
This agreement constitutes the complete and entire understanding between the parties. Any amendments must be made in writing and signed by the party against whom enforcement of any change, waiver, modification, extension, or discharge is sought. Renters are not permitted to assign or transfer this agreement.
By making a reservation and accepting these terms, you consent to receive marketing, promotional, and special offers from Ten35 Seaside Rentals. You may unsubscribe from these communications at any time.
As the guest, you agree to be responsible for any damages to the unit, its furnishings, grounds, or common areas resulting from acts of negligence by you, your family, friends, or guests. You are required to return the unit and its contents at the designated time, in the same condition as at the start of your stay, except for reasonable wear, acts of God, or other circumstances beyond your control. Should the unit not be left in satisfactory condition, you will be charged for the repair, replacement, and restoration of any damaged items, as well as for any lost rental income due to unit unavailability.
Guests agree to pay any reasonable attorney fees and court costs associated with enforcing this agreement, including any appellate proceedings, whether or not legal action is pursued.
Subletting the unit is strictly prohibited. By signing this agreement, you certify that you have read and understood the restrictions regarding the number of occupants allowed in the unit, and agree to comply with all applicable fees and conditions outlined in this agreement.
